Most donated organs in the United States come from brain dead donors, while a small percentage come from patients who die in “controlled,” or expected, circumstances, typically after the family or surrogate makes a decision to withdraw life support. The number of organs available for transplant could be substantially if donations were permitted in “uncontrolled” circumstances–that is, from people who die unexpectedly, often outside the hospital. According to projections from the Institute of Medicine, establishing programs permitting “uncontrolled donation after circulatory (...) determination of death,” or uDCDD, throughout the United States has the potential to provide 22,000 more donation opportunities annually. In contrast, U.S. controlled donation after circulatory determination of death, or cDCDD, cases have increased progressively over the past decade from 87 to 848 donors, but currently account for only 10.6 percent of all deceased donors. Following the IOM recommendations, several projects exploring the feasibility of uDCDD were funded by the federal government, including a grant from the Health Resources and Services Administration that supported a pilot project in New York City in which the authors of this article participated.A key feature of our protocol, and indeed of many uDCDD protocols, is the initiation of preservation methods such as chest compressions and extracorporeal membrane oxygenation shortly after death in order to perfuse and preserve the donor's organs. Critics of uDCDD argue that the means of determining death deviates from generally ascribed principles. They assert that reinstituting circulation in order to preserve organs has the effect of “undoing” the prior determination of death. The result is that cDCDD is widely accepted and practiced routinely even though it only marginally increases the number of organs available for transplantation, and uDCDD is widely considered unacceptable despite being ethically embraced and proven to significantly increase organ donation opportunities in other countries. This article explores the evolution of this counterintuitive state of affairs and calls for a policy that, in line with the IOM report, allows for both cDCDD and uDCDD protocols. (shrink)

Non-suicidal self-injury has consistently been associated with self-reported difficulties in emotion reactivity and the regulation of negative emotions; however, less is known about the accuracy of these self-reports or the reactivity and regulation of positive emotions. The present study sought to investigate differences between women with and without a history of NSSI on: self-reported general tendencies of negative and positive emotion reactivity, self-reported general tendencies of negative and positive emotion regulation, and emotion regulation reported in response to a positive and (...) negative mood induction. The sample consisted of 36 women with a recent history of NSSI within the last 2 years and a comparison group with no history of NSSI. Participants completed self-report measures of negative and positive emotion reactivity and regulation. In a separate session, participants underwent both a negative and positive mood induction using a counterbalanced design and reported their experienced emotions. Results from two-way MANOVAs and ANOVAs revealed those with a history of NSSI reported significantly greater difficulties in negative emotion reactivity and regulation than the no-NSSI comparison group; however, no group differences emerged in self-reported reactivity or regulation of positive emotions. In contrast, repeated measures ANOVAs on data from the mood induction task found no group differences in reactivity or regulation for either negative or positive emotions. These findings highlight the possibility that although individuals with a history of NSSI evaluate their ability to manage negative emotions as significantly worse than individuals with no history of self-injury, this may not reflect their actual emotion regulatory processes. Second-person relations are relations between individuals knowingly engaged in interaction with one another. These are the social contexts within which it is appropriate for one to think of and address another as ‘you’. This dissertation explores the practical consequences for agents of relating to others in this fashion. A critical analysis is offered of Stephen Darwall’s theory of moral obligations in terms of demands that can be addressed from the perspective of a second-person. On the basis of the criticisms (...) raised, a broader conception of ‘second-personal reasons’ is advanced according to which there are a variety of species of practical reasons that are essentially grounded in second-person relations between agents, besides moral obligations. A paradigm case of such a species is the reasons that are presented in requests, and one chapter of this work is devoted to explaining this power people often grant to others: to intentionally create new, discretionary reasons for them. Drawing from several historical antecedents – particularly Martin Buber, Simone Weil and Emmanuel Levinas – the analysis of second-personal reasons is extended to include a discussion of the proper object of agapic love, and a discussion of the possible significance that face-to-face encounters may have for moral epistemology. Pancreatitis is a complex, progressively destructive inflammatory disorder. Alcohol was long thought to be the primary causative agent, but genetic contributions have been of interest since the discovery that rare PRSS1, CFTR and SPINK1 variants were associated with pancreatitis risk. We now report two associations at genome-wide significance identified and replicated at PRSS1-PRSS2 and X-linked CLDN2 through a two-stage genome-wide study. The PRSS1 variant likely affects disease susceptibility by altering expression of the primary trypsinogen gene. The CLDN2 risk allele is (...) associated with atypical localization of claudin-2 in pancreatic acinar cells. The homozygous CLDN2 genotype confers the greatest risk, and its alleles interact with alcohol consumption to amplify risk. In virtue of what do the utterances we make mean what they do? What facts about these signs, about us, and about our environment make it the case that they have the meanings they do? According to a tradition stemming from H.P. Grice through David Lewis and Stephen Schiffer it is in virtue of facts about conventions that we participate in as language users that our utterances mean what they do (see Gr'ice 1957, Lewis 1969, 1983, Schiffer (...) 1972, 1982). This view currently enjoys widespread acceptance among philosophers of mind and language. Though most are not particularly interested in the details of such programs, the dominant view seems to be that something of the sort proposed by Grice, Lewis and Schiffer is basically right. Epistemological contextualism states that propositions about knowledge, expressed in sentences like “S knows that P,” are context-sensitive. Schaffer (2005) examines whether one of Lewis’ (1996), Cohen’s (1988) and DeRose’s (1995) influential contextualist accounts is preferable to the others. According to Schaffer, Lewis’ theory of relevant alternatives succeeds as a linguistic basis for contextualism and as an explanation of what the parameter that shifts with context is, while Cohen’s theory of thresholds and DeRose’s theory of standards fail. This paper (...) argues that Schaffer’s analysis is unsatisfactory since it fails to show that thresholds and standards cannot cope with skepticism, as it is ultimately the conversation participants who control how the conversation plays out. Despite his lack of traditional faith, there are important instances in which Doctor Strange acknowledges the Creator God using expressions drawn from the Western monotheistic traditions. In his Metaphysics, the ancient Greek philosopher Aristotle presents the idea of God, or more specifically a god among the gods, who is responsible for the origin and operation of the (...) whole universe. A more helpful image of God can be found in the writing of Saint Thomas Aquinas, who formed a theological synthesis of Aristotelian philosophy and Christian revelation. According to Aquinas, the all‐good Creator of the universe is the author of the moral law. In the Chronicles of Narnia, author and English professor C. S. You can't be convicted of a crime without a guilty act and a guilty mind." A lawyer might dress the same idea up in Latin: "You can't be convicted of a crime without actus reus and mens rea." Things like that are often said, but what do people mean when they say them? Guilty Acts, Guilty Minds proposes an understanding of mens rea and actus reus as limits on the authority of a state, and in particular the authority of a (...) democratic state, to ascribe guilt through positive law to those accused of crime. Actus reus and mens rea are necessary conditions, among others, for the legitimacy, as distinct from the justice, of state punishment. The actus reus requirement disables a democratic state from using its authority, on the one hand, to ascribe guilt to those who didn't realize they were committing a crime, provided they lacked the capacity to realize they were committing a crime; and on the other, to ascribe guilt to those who realized they were committing a crime, but who lacked the capacity to conform their conduct to the requirements of law. The mens rea requirement disables a democratic state from using its authority, on the one hand, to ascribe guilt to those who didn't realize they were committing a crime, provided their ignorance manifested no lack of law-abiding concern for the law and its ends, and on the other, to ascribe guilt to those who realized they were committing a crime, but whose failure to conform to the law nonetheless manifested no lack of law-abiding concern for the law and its ends. From Descartes to Popper, philosophers have criticized and tried to improve the strategies of reasoning invoked in science and in everyday life. In recent years leading cognitive psychologists have painted a detailed, controversial, and highly critical portrait of common sense reasoning. Stephen Stich begins with a spirited defense of this work and a critique of those writers who argue that widespread irrationality is a biological or conceptual impossibility.Stich then explores the nature of rationality and irrationality: What is it that (...) distinguishes good reasoning from bad? He rejects the most widely accepted approaches to this question approaches which unpack rationality by appeal to truth, to reflective equilibrium or conceptual analysis. The alternative he defends grows out of the pragmatic tradition in which reasoning is viewed as a cognitive tool. Stich's version of pragmatism leads to a radical epistemic relativism and he argues that the widespread abhorrence of relativism is ill founded. (shrink)

Diseases causing inherited retinal degeneration in humans, such as retinitis pigmentosa and macular dystrophy, are genetically heterogeneous and clinically diverse. More than 40 genes causing retinal degeneration have been mapped to specific chromosomal sites; of these, at least 10 have been cloned and characterized. Mutations in two proteins, rhodopsin and peripherin/RDS, account for approximately 35% of all cases of autosomal dominant retinitis pigmentosa and a lesser fraction of other retinal conditions. This target article reviews the genes and mutations causing retinal (...) degeneration and proposes mechanisms whereby specific mutations lead to particular clinical consequences, that is, the relationship between genotype and phenotype. Retinitis pigmentosa and macular dystrophy are genetically heterogeneous diseases that cause retinal degeneration in humans and often result in severe visual impairment or blindness. Although many of the genes causing these diseases have not been identified, three photoreceptor-specific proteins have been implicated: rhodopsin, peripherin/RDS, and the P-subunit of rod phosphodiesterase. Mutations in the genes for these three proteins can cause either dominant retinitis pigmentosa, recessive retinitis pigmentosa, dominant congenital stationary night blindness, or dominant macular degeneration. Why this multiplicity of clinical phenotypes? Our target article summarizes the genetic and biochemical background to this question and proposes a number of possible explanations. Discussion focuses mainly on 73 distinct disease-causing mutations of rhodopsin. We feel that rhodopsin and other photoreceptor proteins can serve as model systems for unraveling the connection between genotype and phenotype, not only for inherited retinal diseases but for other degenerative disorders as well. In a recent paper, Joshua Knobe (2019) offers a startling account of the metaphilosophical implications of findings in experimental philosophy. We argue that Knobe’s account is seriously mistaken, and that it is based on a radically misleading portrait of recent work in experimental philosophy and cultural psychology.

Publishing is changing rapidly, though these changes are concealed from academics, who are presented the appearances of the old world of print. The economic incentives and consequently the strategies of publishers have, however, changed. Where quality was once the road to profit, content now is, and novel digital delivery systems are the key to sales. Academic libraries have become storefronts for digital sales. Editors have become content collectors. At the same time publishing has attempted to mimic the accessibility of the (...) web, shrinking the gap between “publication” and posting. This raises the question of what value is added by journal publication, and whether there is a justification for the huge cost. Some shorter and longer term perspectives suggest that the current value-added is linked to policies of evaluation, but that these may change. (shrink)

In this book, Stich unravels - or deconstructs - the doctrine called "eliminativism". Eliminativism claims that beliefs, desires, and many other mental states we use to describe the mind do not exist, but are fiction posits of a badly mistaken theory of "folk psychology". Stich makes a u-turn in his book, opening up new and controversial positions.

This short review examines the work of four Canadian scholars addressing a variety of questions about criminal responsibility. The essays under review are a small part of a recent collection of essays entitled “Rethinking Criminal Law Theory: New Canadian Perspectives in the Philosophy of Domestic, Transnational, and International Criminal Law.”.

The exercise of synchronic self-control is the way in which an actor can attempt to bring a desire into alignment with his better judgement at the moment and during the interval of time over which, but for the exercise of such self-control, the desire would become the actor’s preponderant desire, which the actor would then translate into an act contrary to his better judgment. The moral psychology of an actor who fails to achieve such self-control can be analyzed in two (...) ways. One way is meant to be consistent with compatibilist metaphysics; the other with libertarian metaphysics. The implications of these analyses for the criminal law are complicated, but perhaps the most important is this: the criminal law should in principle recognize a partial excuse for an actor who exercises synchronic self-control but who gives up his effort because he believes that he can no longer continue to resist. His effort to achieve self-control thus fails, and he ends up translating into action the very desire he set out to control. (shrink)

Normativity is what gives reasons their force, makes words meaningful, and makes rules and laws binding. It is present whenever we use such terms as ‘correct,' ‘ought,' ‘must,' and the language of obligation, responsibility, and logical compulsion. Yet normativists, the philosophers committed to this idea, admit that the idea of a non-causal normative realm and a body of normative objects is spooky. Explaining the Normative is the first systematic, historically grounded critique of normativism. It identifies the standard normativist pattern of (...) argument, and shows how this pattern depends on circularities, assumptions about the unique correctness of preferred descriptions, problematic transcendental arguments, and regress arguments that end in mysteries. The book considers in detail a paradigm case: legal normativity as constructed by Hans Kelsen. This case exemplifies the problems with normativist arguments. But it also shows how normativism was constructed as an alternative to ordinary social science explanation. The normativist argument is that social science explanations themselves are forced to rely on normative conceptsÑminimally, on normative rationality and on a normative view of ‘concepts' themselves. Empathic understanding of the reasoning and meanings of others, however, can solve the regress problems about meaning and rationality that are central to the appeal of normativism. This account has no need for a parallel normative world, and has a surprising and revealing lineage in the history of philosophy, as well as a basis in neuroscience. (shrink)

The lack of "progress" in theory is often contrasted to progress in statistical methodology. The relation between the two bodies of thinking is itself problematic, however, for the particular advances in method that have occurred in quantitative sociology reflect a trade-off in which the results are characterized by the radical underdetermination of models by data and a high level of slack between measures and theoretical concepts. Both of these problems are usually understood as matters of "error," and thus as potentially (...) eliminable, but this claim is highly questionable, on grounds evident from Pearson's philosophy of science. The implications of large ineliminable error for the project of theory construction, particularly the "formal theory" of Blau and the California Positivists, is discussed. The ease of producing statistical results is an achievement, but one that leads away from theory rather than toward it, and, because the fact of underdetermination prevents these results from establishing clear cognitive superiority over the results of other "approaches," theoretical diversity is, in a sense, a consequence of the properties of the dominant statistical tradition in sociology. Recent findings emphasize the complexity, both genetic and functional, of the manifold genes and mutations causing inherited retinal degeneration in humans. Knowledge of the genetic bases of these diseases can contribute to design of rational therapy, as well as elucidating the function of each gene product in normal visual processes.
